Restrictions Overview

  • The Property shall be used exclusively for single family residential purposes. 
  • No noxious or offensive activity shall be conducted on any portion of the Property that will adversely affect the peace, quiet, comfort or serenity of any Owner.
  • All Dwellings must be approved in writing by the Developer prior to being constructed, erected, altered, or placed on the property.
  • All dwellings must have at least 1,200 square feet of air conditioned living area. 
  • All dwellings must have a minimum of a two car garage.
  • Exterior walls must be cementious fiber (such as James Hardie materials), brick, stone, stucco or a combination thereof.
  • No vehicles will be left in the street overnight.
  • All receptacles for trash collection will be removed from the curb side the same day of trash pick up.
  • Rental of any Dwelling shall comply with the City of San Marcos’ Rental Restrictions.
  • No unsightly articles shall be permitted to remain on any Lot so as to be visible from surrounding Lots or public or private thoroughfares.  Travel trailers, boats, campers, buses, motorcycles, and recreational vehicles shall be in at least a three-sided and roofed covered area.
  • Each Lot owner shall pay the Association an annual fee.  The initial maximum assessment shall be $100.00 per year, per Lot, beginning January 1, 2010.
